Liability Waiver

Liability Waiver & Release of Claims

Effective Date: January 2025

This Liability Waiver (“Waiver”) applies to all services performed by Mr. GrabGuy, including its independent subcontractors, affiliate installers, technicians, helpers, assistants, and any parties involved in the installation, sealing, or servicing of grab bars and bathroom safety equipment. By booking or receiving services, you (“Customer”) agree to all terms below.


1. Acknowledgment of Risk

You understand and acknowledge that:

  • Bathrooms, tubs, and showers are inherently slippery environments.
  • No grab bar, anchor, or installation method can eliminate the risk of slips, falls, or injuries.
  • You assume all risks associated with the use, misuse, or overloading of grab bars and safety products.
  • Improper use or pulling at angles not intended by the manufacturer can cause equipment failure.

2. Tile, Wall, and Structural Conditions

You acknowledge that hidden wall conditions may not be visible prior to drilling, including:

  • Loose tile, hollow tile, weak grout, thin-set failure, or moisture damage
  • Inconsistent studs, blocked studs, electrical or plumbing behind the wall
  • Weak drywall, old materials, or sub-surface deterioration

You agree that:

  • Mr. GrabGuy and its subcontractors are not responsible for tile cracking, grout failure, wall movement, or structural issues that arise during or after installation.
  • Any repairs beyond installation (e.g., tile replacement, waterproofing, cosmetic repairs) are the sole responsibility of the Customer.

3. Customer-Supplied Products

If you provide your own grab bars, anchors, or hardware:

  • They are installed “as is.”
  • We do not verify manufacturer load ratings or ADA compliance.
  • We do not assume liability for product failure or defects.
  • Responsibility for warranty or replacement remains solely with the manufacturer.

4. Medical & Mobility Disclaimer

You acknowledge that:

  • Installers do not provide medical, occupational therapy, or professional mobility advice.
  • Placement suggestions are based on general practices, not medical evaluation.
  • You are responsible for consulting a licensed medical or mobility professional about your specific needs.

5. Release of Liability

To the fullest extent permitted by law, you agree to release, indemnify, and hold harmless:

Mr. GrabGuy, its owners, employees, independent subcontractors, affiliate installers, technicians, helpers, assistants, representatives, and any parties performing work on behalf of the company

from any and all claims, demands, losses, injuries, damages, or expenses arising from:

  • Slips, falls, or injuries of any kind occurring before, during, or after installation
  • Improper use or overloading of grab bars or safety equipment
  • Tile cracking, grout issues, or structural defects in the Customer’s home
  • Product defects, manufacturing issues, or hardware failures
  • Customer-assisted lifting, handling, or participation in installation

This release applies whether the claim arises from negligence (ordinary), conditions of the premises, or any other cause permitted by law.

6. Limits of Liability

You agree that total liability of Mr. GrabGuy and all parties associated with your service is strictly limited to the cost of the installation service performed, not including parts or products.

We are not liable for:

  • Consequential, incidental, or special damages
  • Medical bills or long-term healthcare costs
  • Property damage not directly caused by installer negligence

7. Consent to Perform Work

By allowing installers to enter the premises and begin work, you acknowledge:

  • You have the authority to authorize drilling into walls, tile, or surfaces.
  • You understand that drilling into existing tile can result in breakage.
  • You accept full responsibility for any hidden conditions affecting installation.

8. Acknowledgment & Acceptance

By scheduling service, allowing technicians into your home, or using any installed product, you affirm that you have read, understood, and voluntarily agree to this Liability Waiver.

If you do not agree, you must cancel your appointment before work begins.
